John Puglisi, Jr. v. Town of Hempstead Sanitary District No. 2, U.S. District Court, Eastern District of New York, Docket NO.: CV-11-445 (JFB)

Sanitation worker John Puglisi, Jr. sued his employer, Town of Hempstead Sanitary District No. 2, including several of its employees and officials. Mr. Puglisi alleged that his rights as an employee were violated under Title VII, Civil Rights Act of 1964, 42 U.S.C. § 2000(e); 42 U.S.C. §1983 under the First and Fourteenth Amendments of the United States Constitution; 42 U.S.C. §1983 and NYS Executive Law §296, based on Puglisi’s experience of unfair, unlawful and unequal treatment, a hostile work environment, and retaliation after his father, John Puglisi, Sr., made statements to the New York State Department of Human Rights opposing discriminatory practices by the defendants, Town of Hempstead Sanitary District No. 2. Mr. Puglisi had been a sanitation worker for over a decade and claimed that in retaliation for the complaints of discrimination, his workload increased disproportionately to the other workers and was forced on several occasions to pick up dangerous, hazardous, and illegal materials that were in violation of various ordinances and Occupational Safety and Health Administration requirements. The Defendants filed a motion for summary judgment, seeking the discussed facts of the case without a trial. After consideration of the motion papers, including opposition to Sanitation District’s motion filed by Frederick K. Brewington, Esq. and Precilla Lockett, J.D. of The Law Offices of Frederick K. Brewington, on January 9, 2013, Hon. Joseph F. Bianco, U.S. District Court Judge, denied the Defendants’ motion for summary judgment and ruled that the Plaintiff’s claims were sufficient to proceed to trial.
