Saeed v. County of Nassau, et.al., Docket No.: CV-09-3314 (DRH)(AKT)
Plaintiff Shomari Saeed sued his employer, as well as some of its employees and officials, alleging that his rights as an employee were violated under Title VII; Title VI, 42 U.S.C. §1985 and §1986, 42 U.S.C. §1983 and NYS Executive Law §296. Mr. Saeed served as an Investigator at the Nassau County Sheriff’s Department and alleged that he endured several encounters of harassment and discrimination on the basis of race, religion and sexual orientation, and that his numerous complaints filed with the Department resulted in retaliation and intimidation. Mr. Saeed claimed that his supervisor made several sexually explicit comments and was harassed by making unwanted advances based on the supervisor’s perception of him as a Homosexual Muslim African-American male. Mr. Saeed’s attempts to file complaints against his supervisor were either ignored or led to intimidation. In retaliation, Mr. Saeed was unfairly reprimanded for following justified procedures during investigations, and was wrongfully issued a Notice of Personal Action, which resulted in the plaintiff’s five day suspension without pay and an additional loss of twenty days’ vacation leave entitlements. The Defendants also threatened Mr. Saeed, hindered his ability to perform his duties, and prevented his promotion to other positions in the department, despite his clear qualifications for those positions. The Defendants filed a motion for summary judgment, but the motion was denied by Honorable William F. Kuntz, U.S. District Court Judge, who ruled the plaintiff’s claims, as represented by Valerie M.
