Pedestrian Struck By Box Truck That Drove Through Red Light Obtains $777,000 Settlement
The Law Offices of Frederick K. Brewington was successful in settling a major personal injury case that arose from an automobile accident on February 14, 2014. Plaintiff Donald Dougherty, 68 years old, was crossing Lakeview Ave. in Lynbrook, N.Y., with a green traffic signal, when he was struck by a box truck operated by Lauren Wallace, who was making a left turn. Mr. Dougherty was in the intersection at the time of the accident.
Mr. Dougherty was immediately taken to South Nassau County Communities Hospital, where he remained for a week. He was then transferred to Mercy Hospital, where he remained until March 6, 2014. He suffered injuries, including four lumbar vertebrae fractures, a compression fracture at L-2, a fracture of the proximal fibular shaft at the fibular head of the right leg, fracture of the proximal fibular shaft, fracture of the right T12 rib, and exacerbation of atrial fibrillation condition, necessitating insertion of a pacemaker. Mr. Dougherty underwent a total knee replacement during a subsequent hospitalization at South Nassau Communities Hospital from May 7 to May 9, 2014. At the time of the accident, Mr. Dougherty was a substitute teacher at the Malverne School District.
Ira Fogelgaren handled the case from its inception and was joined by Frederick K. Brewington at the time of the settlement. The case was settled for $777,000 at a mediation on January 13, 2016.
