Federal Court Sanctions County of Nassau in False Arrest Case

Plaintiff Michael Smith filed a civil rights action against Defendants County of Nassau, Anna Gaetano, Harry Terezakis, Zurich Associates, LTD., Police Officer Timothy Slevin and other officers after Mr. Smith was wrongfully arrested for criminal trespass for residing at a residence with his fiancée, pursuant to a scam in which Michael Smith and his fiancée were victims. The Defendants, wrongfully accused, stopped, detained, seized, falsely arrested, falsely imprisoned, abused, harassed, wrongfully evicted, and maliciously charged Plaintiff with crimes that he did not commit. Over the course of discovery the Defendants’ counsel failed to submit a response to Plaintiff's requests and refused to comply. After refusing to comply with discovery requests and stalling for nearly six months, Gregory Calliste, Jr. Esq. of the Law Offices of Frederick K. Brewington, filed a Motion to Compel and a motion seeking sanctions on behalf of Mr. Smith. On March 26, 2013, Federal Magistrate Judge, the Honorable E. Thomas Boyle, decided that sanctions should be awarded in favor of the Plaintiff against the Defendants’ counsel, an Assistant County Attorney. As a result of ignoring and violating court orders and failing to serve and respond to discovery demands, sanctions were set at $500.00 per day from October 18, 2012 and continuing as long as the noncompliance continued. The Judge also decided that the County would be precluded from offering evidence if their failures continued.
