Ruling in the "Long Beach Five" Case
In November 2010, five Long Beach men were falsely accused by Long Beach Police of and arrested for attempted assault in the third degree, resisting arrest, obstructing governmental administration in the second degree and riot for an incident that occurred on that night. The “Long Beach Five,” including Derrick Patten, who is represented by The Law Offices of Frederick K. Brewington and four other men were assaulted, beaten, pepper sprayed, tased, falsely arrested, falsely accused, illegally imprisoned, and are being maliciously prosecuted by the Long Beach Police Department and Nassau County District Attorney. On behalf of all of these men, Frederick K. Brewington, Esq. and Johanna David, Esq. of The Law Offices of Frederick K. Brewington issued a subpoena that called for the City of Long Beach and The City of Long Beach Police Department to release all records, documents, complaints, reports, correspondence, notes, memo-book entries, directives, notices, orders, commands, tapes, photos, notations, findings, evaluations, interviews and all relevant information concerning the investigation of allegations regarding the actions of police, as well as the arrest of Mr. Patten and those arrested with him. The City of Long Beach filed a motion to quash the subpoena, requesting that they not be required to produce the items sought. After consideration of the legal issues relating to the subpoena, Honorable Susan T. Kluewer denied the City of Long Beach motion, and ordered that the materials be presented as per the subpoena. Trial for this case is expected to commence this month. |
