Former Suffolk County Prosecutor Files $5 Million Federal Lawsuit against District Attorney’s Office, Claiming Racial Harassment and Discrimination and Unjust Dismissal

Frederick K. Brewington has filed a $5 million federal lawsuit on behalf of an assistant district attorney who worked in Suffolk County District Attorney Thomas Spota’s office. The plaintiff claimed she was subjected to discriminatory actions and harassment and later terminated because of her race and nationality.

Rashika N. Hettiarachichi, a native of Sri Lanka and an eleven-year employee with the Suffolk DA's office, previously filed a complaint with the New York State Division of Human Rights, which allowed her to proceed with the lawsuit. Ms. Hettiarachichi said she was subjected to racial harassment, discrimination and retaliatory actions. When in 2013 she disclosed to her employer that she was diagnosed with bipolar disorder, Ms. Hettiarachichi was reported — and eventually fired — for what the county said was poor job performance.

"Ms. Hettiarachichi dedicated her professional life to the people of Suffolk County for more than 10 years," Mr. Brewington said. "It wasn’t until she disclosed her medical condition that her employer — who should have treated her better — decided to find a reason to terminate her and they did so in an unjust and discriminatory matter."
