Malicious Prosecution of Shirley Woman Foiled by Dismissal of All Criminal Charges

On or about September 22, 2012, at or about 10:50 pm, while in her residence located in Shirley, NY (County of Suffolk), Jessica Roger was accosted, harassed, assaulted, put in fear of her life and subjected to excessive force, assault, battery, cruel and unusual punishment, abuse and mistreatment by Police Officer Frank Santanello and other officers from the Suffolk County Police Department, all in violation of her civil rights. Despite Ms. Roger’s repeated requests for the police officer(s) to cease the assault, Ms. Roger was violently beaten up by the police officer(s), who eventually discontinued the assault when witnesses intervened. After physically violating Ms. Roger’s rights, the county and the police then subjected Ms. Roger to false arrest, false and unlawful imprisonment, malicious prosecution, abuse of process, and intentional infliction of emotional harm, among other things.

Ms. Roger was — and continued to be — falsely charged and maliciously prosecuted for violations of the Penal Law in Suffolk County District Court, for the baseless charges of resisting arrest, obstructing governmental administration and harassment in the second degree. Ms. Roger endured more than 1,300 days of having these charges as a dark cloud hanging over her. After three years and seven months of fighting this unlawful prosecution, the criminal charges were dismissed on April 7, 2016 by Judge Robert L. Cicale of the Suffolk County District Court.

Judge Cicale wrote, “The People have furnished neither medical documentation in support of CPL 30.30(4)(g) exclusions nor transcripts in opposition to the defendant's moving papers. Neither have the People alleged a readiness announcement or furnished any documentary proof of same. The defendant's motion to dismiss must be granted.” This dismissal has led to Ms. Roger’s federal civil rights lawsuit, which has been pending.

In September 2013, Ms. Roger commenced her lawsuit against Suffolk County, Officer Santanello and others, for her wrongful detention by the police officers, denial of medical assistance and being handcuffed to a desk all night while she was in pain and in need of treatment, thereby violating her rights. Not only was Ms. Roger forced to defend herself vigorously as she was facing potential jail time and a criminal record as a result of these false accusations, but she sustained multiple injuries and levels of damage, including, but not limited to, serious and permanent emotional injuries, serious and permanent personal and bodily injury (including, but not limited to, several herniated discs in her spine, bruises and contusions and other injuries to her head, neck, back and limbs, mental anguish, mental pain and suffering), all at the hands of the County of Suffolk, Police Officer Santanello and others.

The criminal case was handled by Frederick K. Brewington, who is also handling the federal case, which is currently before Judge Joanna Seybert of the U.S. District Court, Eastern District of New York.
