NYS Human Rights Division Finds Probable Cause of Discrimination and Retaliation Suffered by Vascular Technologist The New York State Human Rights Division recently ruled in favor of Janet Kronemberg, a client of The Law Offices of Frederick K. Brewington, who they determined showed probable cause that she was subject to discrimination and retaliation by her supervisor. The investigation uncovered that Ms. Kronemberg, a registered vascular technologist at Winthrop University Hospital, faced discrimination and retaliation by Ms. Patrice Villa, who became Ms. Kronemberg’s supervisor in February of 2011. After experiencing what she felt was unjust treatment by Ms. Villa, Ms. Kronemberg filed a complaint with the division on June 6, 2012 alleging discrimination on the basis of her race and age. Although it was determined that there was no probable cause at that time, Ms. Kronemberg asserted that after the initial complaint, Ms. Villa created a hostile work environment for her and proceeded to write her up for minor infractions. Ms. Kronemberg also claimed that, as part of the retaliation, she was asked to take a second credentialing exam despite passing the first one, and was suspended without pay after refusing to sign a “negative and disparaging” evaluation which eventually led to her termination on March 11, 2014. On April 15, 2014, the firm filed a complaint on behalf of Ms. Kronemberg, alleging that Ms. Villa engaged in unlawful discriminatory practices. After reviewing all of the documents and witness testimony, the Human Rights Division ruled on October 9 that Ms. Kronemberg was unfairly treated by Ms. Villa.
